WHEREAS the Employer is desirous that certain Works should be constructed, viz .............................................

NOW THIS AGREEMENT WITNESSES that:

1 .In this Agreement words and expressions shall have the same meanings as are respective1y assigned to them in the General Conditions of Contract hereinafter referred to.

2. The fol1owing documents shall be deemed to form and be read and construed as part of this Agreement, viz:

(a) The said Tender and Appendix;
(b) The General and Specia1 Conditions of Contract;
(c) The Specifications;
(d) The priced Schedule of Quantities;
(e) The Schedule of Rates and Prices*;
(f) The Drawings;
(g) The Letter of Acceptance;

3. In consideration of the payments to be made by the Employer to the Contractor as hereinafter mentioned the Contractor undertakes to the Employer to construct, complete and remedy any defects in the Works in conformity in al1 respects with the provisions of the Contract.

4. The Emp1oyer hereby undertakes to pay to the Contractor in consideration of the construction, comp1etion and defects correction of the Works the Contract Price at the times and in the manner prescribed by the Contract.
