23.(1) Engagement of employees
The Contractor shall, unless otherwise provided in the Contract, make his own arrangements for the engagement of all employees and for their payment, housing, feeding and transport (provided that any use of any part of the Site for the said purposes shall be subject to the prior approval of the Engineer) and the Contractor hereby indemnifies the Employer against any liability arising out of the Contractors said arrangements whether involving the use of the Site or otherwise.
(2) Accommodation and care of employees
The Contractor shall provide and maintain on the Site adequate and suitable sanitary and first aid services and a supply of potable water for his employees engaged on the Contract and, if necessary, suitable accommodation and similar facilities elsewhere for such employees off the Site.
(3) Information in respect of employees
The Contractor shall, if instructed by the Engineer, deliver to the Engineer information, in such form and at such intervals as the Engineer may prescribe, in respect of employees from time to time employed by the Contractor on the Site.
The Contractor shall employ on the Site, for the execution and completion
of the Works, only such persons as are careful, competent and
efficient in their several trades and callings.
The Engineer shall be entitled to instruct the Contractor to remove
forthwith from the Works any person employed by the Contractor in or about the execution
of the Works who, in the opinion of the Engineer, misconducts himself or
is incompetent or negligent in the proper performance of his duties, or
whose presence on the Site is otherwise considered by the Engineer on
reasonable grounds to be undesirable, and such person shall not again be
employed on the Works without the permission of the Engineer.
25.(1) Contractors superintendence
The Contractor shall provide all necessary superintendence during the execution of the Works.
The Contractor or a competent and authorised agent or representative approved of in writing by the Engineer (which approval may at any time be withdrawn), hereinafter called the Contractors Site Agent, shall be on the Site at all times when work is being performed or when the Engineer shall reasonably require.
(3) Site Agent to receive instructions
The Contractors Site Agent shall have authority to receive, on behalf of the Contractor, all oral or written communications from the Engineer or the Engineers Representative or other person authorised by the Engineer in terms of Clause 2(5).
